Shimabukuro, American Law Division Abstract: This report discusses section 194 of the Lieberman substitute amendment to S. 2452, the National Homeland Security and Combating Terrorist Act of 2002. Section 194 would require all laborers and mechanics employed by contractors or subcontractors on construction projects financed in whole or in part with assistance received under the Act to be paid locally prevailing wages in accordance with the Davis-Bacon Act. This report considers the effect section 194 could have on construction projects undertaken by agencies or related to programs transferred to the proposed Department of Homeland Security.
