Abstract: This report examines the background and significance of both the inclusion and exclusion of sound recordings as specially commissioned works for hire under the Copyright Act. While the inclusion of sound recordings in the definition was intended to signify that they were a permissible category, paradoxically, the subsequent exclusion of the term does not signify that they are not included. By returning to the pre-1999 status quo, the law remains unsettled.
