Title: Bankruptcy Relief and Natural Disaster Victime

Abstract: In the wake of Hurricane Katrina, many questioned whether implementing the new procedures of the Bankruptcy Abuse Prevention and Consumer Protection Act (BAPCPA), P.L. 109-8, which became effective on October 17, 2005, should have been delayed. Others have suggested that the U.S. Bankruptcy Code, 11 U.S.C. § 101 et seq., as amended by the BAPCPA, may need legislative adjustments to meet the special needs of disaster victims. Several bills that address this issue have been introduced. This report considers whether bankruptcy law in general, and the new law in particular, may present unique challenges to financial recovery for those whose life, livelihood, and/or home have been damaged or destroyed.
