Abstract: Copyright owners have exclusive control over protected material, including the right to authorize the reproduction, distribution and public performance of their work. In 1995, Congress enacted the Digital Performance Right in Sound Recordings Act, which created a limited public performance right for sound recordings. Copyright owners of sound recordingsrecord companies and recording artistsnow enjoy the exclusive right to control or authorize public performances by means of digital transmission. This public performance right is triggered when sound recordings are transmitted over the Internet, or webcast.
