Abstract: On March 13, 2002, the Class Action Fairness Act of 2002 (H.R. 2341) passed the House. Similar legislation is pending in the Senate (S. 1712). Both bills allow defendants to move certain class action cases from state to federal court on diversity grounds (plaintiffs from different states than defendants) even in the absence of the complete diversity.
