Abstract: this report summarizes the Supreme Court's decision in Seminole Tribe of Florida v. Florida, __U.S.,__, 116 S.Ct. 1114 (1996), holding unconstitutional the provision of the Indian Gaming Regulatory Act of 1998, Pub. L. 100-487, 102 Stat. 2467, 25 U.S.C., Sections 2701 et seq., that authorized an Indian tribe to sue a state in federal court to compel a tribal-state compact for Class III or casino-type gaming.
